Sau các tư vấn của Cơ quan giám sát chứng khoán và thị trường châu Âu (ESMA) được đưa ra vào hồi tháng 5 vừa qua, nhiều người đã kỳ vọng tiền điện tử và một vài loại hàng hóa sẽ được nằm trong khung pháp lý UCITS.<\/p>

Tuy nhiên, Hiệp hội Quản lý Tài sản và Quỹ châu Âu (EFAMA) vừa lên tiếng bác bỏ khả năng diễn ra một làn sóng thành lập quỹ ETF cho các lớp tài sản mới như tiền điện tử.<\/p>

Quan điểm khác biệt của các quốc gia châu Âu khiến ESMA phải xem xét lại khung pháp lý<\/h2><\/span>

Quy định về đầu tư tập thể các sản phẩm chứng khoán có khả năng chuyển nhượng (viết tắt là UCITS) được coi là cơ sở pháp lý căn bản cho các quốc gia châu Âu quản lý những quỹ đầu tư như quỹ hỗ tương và quỹ hoán đổi danh mục (ETF). Mục tiêu hàng đầu của nó là bảo vệ nhà đầu tư, cùng với đó là khiến việc mua bán chứng chỉ quỹ diễn ra dễ dàng hơn giữa các nước châu Âu.<\/p>

Tuy nhiên, vướng mắc nằm ở việc các quốc gia châu Âu khác nhau lại hiểu các quy định này một cách khác nhau. Điều này khiến ESMA phải đánh giá lại quy định để đưa ra hướng dẫn cụ thể hơn.<\/p>

Tiền điện tử, đặc biệt là dưới dạng sản phẩm giao dịch hoán đổi (ETP) đã là tâm điểm trong lần cải cách này. Sự thịnh hành ngày càng tăng của nó tại châu Âu và việc chấp thuận Bitcoin<\/a> ETF tại Mỹ đã làm dấy lên các cuộc tranh luận nảy lửa về việc liệu nó có nên được nằm trong khung pháp lý của UCITS hay không.<\/p>

UCITS hiện không bao gồm quy định về tiền điện tử, đồng thời không cho phép các quỹ ETF chỉ đầu tư chỉ một tài sản duy nhất nhằm giúp nhà đầu tư tránh phải sự thua lỗ cục bộ. <\/p>

Các công ty quản lý quỹ ủng hộ sự thống nhất của UCITS, cảnh báo việc chấp nhận tiền điện tử quá sớm<\/h2><\/span>

EFAMA tin rằng việc cải cách quy định UCITS ở thời điểm hiện tại là chưa cần thiết. Thay vào đó, việc làm rõ về nó cho các nước châu Âu sẽ giúp đảm bảo sự đồng bộ về mặt quy định trên khắp lục địa này. <\/p>

Hiệp hội này cho rằng việc đầu tư tiền điện tử qua các sản phẩm ETP là lựa chọn dễ dàng hơn. Những sản phẩm như vậy sẽ loại bỏ sự phức tạp trong việc nắm giữ các tài sản cơ bản này.<\/p>

“Tôi không kỳ vọng xuất hiện thêm ETF<\/a> cho các lớp tài sản mới mà thay vào đó lần lượt mở rộng quy định đến một mức nào đó mà các đơn vị giám sát cảm thấy thoải mái với việc không cần thực hiện các quy trình quản lý quá nghiêm ngặt với những loại tài sản cơ bản mới, ví dụ như hàng hóa vật lý”, Phó Giám đốc EFAMA phụ trách về quy định chính sách, bà Federico Cupelli bày tỏ quan điểm rõ ràng.<\/p>

Nếu các nhà đầu tư muốn tham gia vào thị trường tiền điện tử<\/a> tại các quốc gia EU, họ phải dựa vào các sản phẩm thay thế ví dụ như trái phiếu giao dịch hoán đổi (ETN). ETN và ETF cùng được coi sản phẩm giao dịch hoán đổi (ETP) và thường cũng được bảo chứng bởi Bitcoin “vật lý”. <\/p>

Một số công ty đầu tư châu Âu như 21Shares, VanEck, ETC Group và Deutsche Digital Assets (DDA) đều đang cung cấp Bitcoin ETN. Tuy nhiên về mặt pháp lý, nhà đầu tư vào ETN không được bảo vệ như ETF. Trong trường hợp đơn vị phát hành phá sản, tiền của khách hàng sẽ không được tách biệt với tài sản thanh lý phá sản.<\/p>
