สำนักงานคณะกรรมการกำกับหลักทรัพย์และตลาดหลักทรัพย์ (ก.ล.ต.) ของประเทศไทยได้เสนอร่างกฎระเบียบข้อบังคับใหม่เกี่ยวกับการลงทุนในคริปโตเคอร์เรนซีของกองทุนรวมและกองทุนส่วนบุคคล <\/p>

หลักการที่เสนอ ซึ่งประกาศเมื่อวันพุธ<\/a> กำลังอยู่ในขั้นตอนการขอความคิดเห็นจากสาธารณะเกี่ยวกับการปรับปรุงเกณฑ์การลงทุนของกองทุนรวมในสินทรัพย์ดิจิทัล<\/p>

การเคลื่อนไหวดังกล่าวเกิดขึ้นในช่วงที่ความสนใจในการลงทุนสกุลเงินดิจิทัลกำลังเพิ่มขึ้น โดยประเทศไทยซึ่งเป็นหนึ่งในประเทศที่เป็นมิตรกับสกุลเงินดิจิทัลมากที่สุดในโลก อยู่ในอันดับที่ 10 ของโลกในแง่ของการยอมรับคริปโต<\/a><\/p>

หน่วยงานกำกับดูแลระบุว่า กองทุนจะได้รับอนุญาตให้ลงทุนในกองทุนรวม ETF (Exchange-Traded Funds) ที่จดทะเบียนอยู่ในตลาดหลักทรัพย์ของสหรัฐอเมริกา นอกจากนี้ ยังอนุญาตให้กองทุนเลือกโทเค็นการลงทุนได้ ซึ่งได้รับความสนใจจากนักลงทุนชาวไทย<\/p>

“กองทุนจะได้รับอนุญาตให้ลงทุนในโทเค็นการลงทุนภายใต้ข้อจำกัดการลงทุนปัจจุบันของหลักทรัพย์แบบดั้งเดิม เช่น ข้อจำกัดนิติบุคคลเดี่ยว ข้อจำกัดกลุ่ม และข้อจำกัดด้านการกระจุกตัวของการลงทุน”<\/p>

ประกาศดังกล่าวระบุว่า นักลงทุนสถาบันและบุคคลที่มีมูลค่าทรัพย์สินสุทธิสูงมากซึ่งมีความสามารถรับความเสี่ยงสูง กองทุนจะได้รับอนุญาตให้ลงทุนในกองทุนรวม ETF ที่เกี่ยวข้องกับคริปโตโดยไม่มีข้อจำกัดในการลงทุน<\/p>

นายเอนก อยู่ยืน รองเลขาธิการ ก.ล.ต. ไทย กล่าวว่าการลงทุนในโทเค็นการลงทุนจะมีอัตราส่วนการลงทุนเช่นเดียวกับหลักทรัพย์ที่โอนเปลี่ยนมือได้ เนื่องจากโทเค็นเหล่านี้มีความเสี่ยงและลักษณะสำคัญที่คล้ายคลึงกับหลักทรัพย์แบบดั้งเดิม เช่น หลักทรัพย์หนี้ ตามรายงานของ Bangkok Post<\/a><\/p>

“จะปรับปรุงหลักเกณฑ์ที่เกี่ยวข้องเพื่อสนับสนุนการจัดตั้งและจัดการกองทุนที่ลงทุนในสินทรัพย์ดิจิทัล เช่น การดูแลสินทรัพย์ การคำนวณมูลค่าสินทรัพย์ดิจิทัล การเปิดเผยข้อมูล และการโฆษณาที่เหมาะสม”<\/p>

ประเทศไทยอนุมัติกองทุน ETF คริปโตตัวแรก<\/a>ในเดือนมิถุนายน ซึ่งออกโดยบริษัทหลักทรัพย์จัดการกองทุน วัน แอสเซ็ท แมเนจเมนท์ (ONEAM) โดย ก.ล.ต. ได้ให้การรับรองกองทุนบิทคอยน์ ETF ของ ONEAM ซึ่งถือเป็นก้าวสำคัญในการพัฒนากรอบกฎระเบียบสำหรับสินทรัพย์ดิจิทัลของประเทศ<\/p>

ก.ล.ต. ไทยพิจารณาการเสนอขายเหรียญครั้งแรก (ICO) และเพิ่มบทลงโทษสำหรับบริษัทคริปโตที่ละเมิดกฎหมาย<\/h2><\/span>

นอกจากนี้ หน่วยงานกำกับดูแลยังพิจารณาอนุญาตให้แพลตฟอร์มการเสนอขายเหรียญครั้งแรก (ICO) ที่ได้รับอนุญาตสามารถใช้บริษัทที่ได้รับการว่าจ้างภายนอกอีกด้วย<\/p>

“มาตรการนี้ได้รับการรับรองจาก ก.ล.ต. และจำเป็นต้องมีการรับฟังความคิดเห็นจากสาธารณะก่อนที่จะสามารถดำเนินการได้” นายเอนก อยู่ยืน กล่าว<\/p>

นอกจากนี้ ก.ล.ต. ไทยจะอนุญาตให้บริษัทเอกชน 10 แห่งทำการทดลองแลกเปลี่ยนคริปโตเป็นเงินบาท ซึ่งเป็นส่วนหนึ่งของโครงการทดลองกฎระเบียบสินทรัพย์ดิจิทัลในรูปแบบ sandbox<\/a><\/p>

นอกจากนี้ บริษัทคริปโตที่ละเมิดกฎของ ก.ล.ต. จะถือว่าเป็นความผิดร้ายแรง ดังนั้น หน่วยงานกำกับดูแลจึงตั้งเป้าหมายที่จะเพิ่มบทลงโทษสำหรับบริษัทเหล่านี้ นอกเหนือจากการเพิกถอนใบอนุญาตของพวกเขา<\/p>
