\n헤스터 피어스(Hester Peirce) SEC 위원이 최근 가상화폐 스타트업 LBRY와 SEC 사이 진행된 SEC의 소송에서 위원회의 대응 방식을 두고 강하게 비판했다.<\/p>

가상화폐 산업에 친화적 입장을 가진 것으로 알려진 피어스는 지난주 금요일 발표한 성명<\/a>에서 토큰 프로젝트에 증권법이 분명하게 적용된다는 SEC의 주장이 근거 없다고 했다.<\/p>

위원회의 주장과 달리 피어스는 LBRY 같은 회사가 토큰 판매를 SEC에 등록할 적합한 수단이 현재 없다고 설명했다.<\/p>

게다가, 그녀는 이러한 등록이 가능하다 하더라도 실용적 가치가 적을 것이라고 강조하며 다음과 같이 전했다:\n<\/p>

“설사 가상화폐 회사가 토큰 판매를 등록할 수 있다 할지라도 특별히 유용한 행위는 아닐 것이다.”<\/p><\/blockquote>

\n피어스는 투자자 보호를 위한 규제 준수의 중요성은 강조하면서도 토큰 프로젝트가 규제 당국의 승인을 확보할 현실적 대안이 부족하다고 비판했다.\n<\/p>

LBRY, 파산 절차 밟기로 결정<\/strong><\/h2>

<\/span><\/p>

\n피어스의 발언 전에 LBRY은 최근 회사를 청산하기로 결정했다고 밝혔다.<\/p>

몇 년 동안 SEC와의 법적 분쟁이 이어진 결과로, 당시 위원회는 LBRY가 미등록 증권을 판매하여 토큰 판매로 1,100만 달러의 자금을 달러, 비트코인 등으로 조달했다고 주장했다.<\/p>

피어스는 LBRY를 기소하기로 한 SEC의 결정을 지지하지 않았다고 밝히면서 소송이 진행되는 동안 공개적으로 발언할 수 없었다고 전했다.<\/p>

토큰이 규제 당국의 감독을 받아야 하며 11만 1,614달러의 벌금을 내야 한다는 법원의 판결에 LBRY은 이전에 항소했지만 이내 항소를 포기했다.<\/p>

LBRY은 SEC와 법률 팀, 사적 채무자에 대한 부채를 상환할 수 없는 상황이라고 설명했다.<\/p>

파산 절차에 따라 오디시(Odysee)를 포함한 회사의 자산은 법정 관리에 들어가게 되었다.<\/p>

LBRY이 지난주에 발표하기를 “이 시점을 기준으로 모든 LBRY 임직원과 이사가 사임했다. 단지 법적 미결 의무를 진행하기 위한 업무만 진행할 것이다.”<\/p>

2022년 7월에 나온 판결은 LBRY의 토큰 LBC가 증권으로 분류되어야 할지를 명시하지 않았다.<\/p>

피어스는 이러한 불명확함 때문에 LBRY 블록체인이 어려운 길이될지라도 계속 존재할 수 있다는 의미가 된다고 지적했다.<\/p>

SEC는 2021년 3월에 LBRY를 기소하며 회사가 2016년부터 2020년가지 미등록 증권을 기관 투자자와 플랫폼 사용자에게 판매했다고 주장했다.<\/p>

SEC는 또한 LBRY 크레딧 토큰(LBC)이 1933년 증권법에 따라 증권으로 분류된다고 주장했다. 미국증권거래위원회는 2018년 5월부터 3년 동안 블록체인 발행 플랫폼 LBRY를 조사했다.<\/p>

SEC는 2022년 11월에 승소했으며 담당 판사는 LBC(LBRY 크레딧 토큰)이 분명 증권이라고 판시했다.<\/p>

본래 SEC는 민사 처벌과 환수로 구성된 총 벌금 4,400만 달러와 LBC의 판매 중단 명령을 요구했다.<\/p>

그러나 LBRY가 2,200만 달러의 벌금을 감당하지 못할 가능성이 크다는 점을 인지한 후 LBRY의 재정적 어려움과 파산에 가까운 상태를 들어 법원에 벌금을 11만 1,614달러로 감할 것을 요청했다.<\/p>
