미국 증권거래위원회(SEC)가 법 집행을 통해 암호화폐 산업을 규제하려는 노력이 계속되면서 파산한 암호화폐 거래소 비트렉스(Bittrex)가 가장 최근에 타격을 입었다. <\/p>

SEC는 4월에 미등록 증권 판매 혐의로 비트렉스를 기소했으며 이제 비트렉스가 SEC에 2,400만 달러의 벌금을 납부하기로 합의했다. <\/p>

법원에 제출된 합의 서류에 따르면 비트렉스는 SEC의 혐의를 인정하거나 부인하지 않았다. <\/p>

비트렉스는 장부에 자기자본 5억 달러, 부채 10억 달러를 지닌 채 지난 5월에 챕터 11에 따른 파산 신청을 했다. <\/p>

비트렉스, SEC 집행 강화에 따른 가장 최근의 희생양<\/strong><\/h2><\/span>

비트렉스는 미등록 증권 판매로 SEC의 공격 대상이 된 미국 기반의 수많은 거래소 및 암호화폐 기업 중 하나이다. <\/p>

유사하게 크라켄은 2023년 초 SEC와 합의하며 가상화폐 스테이킹 서비스를 중단하고 3,000만 달러의 벌금을 납부하기로 했다. <\/p>

스테이블코인 발행사 팍소스는 BUSD가 미등록 증권이라는 SEC의 사냥에 따라 바이낸스USD 발행을 강제 중단하게 되었다. <\/p>

SEC는 코인베이스<\/u><\/a>와 바이낸스에 대해서도 미국에서 미등록 증권 거래소를 운영한 혐의로 기소했다. 바이낸스의 경우 여기에 고객 자금 오용, 관리 미흡 등의 혐의도 추가되었다. <\/p>

SEC의 태도는 지난해 테라 생태계와 FTX 등 유명 가상화폐 기업이 잇따라 파산하면서 더욱 강경해졌다. <\/p>

FTX는 미국의 여러 정치인과 규제기관의 비위를 맞춘 것으로 유명했다. 일부 분석가들은 SEC와 더 넓게는 미국 정부가 전 FTX CEO 샘 뱅크먼-프리드<\/u><\/a>에 “사기”당한 것을 두고 가상화폐 산업에 복수하고 있다고 지적하기도 했다. <\/p>

SEC 겐슬러, ‘비트코인 외에는 모두 증권’<\/strong><\/h2><\/span>

SEC 의장 개리 겐슬러(Gary Gensler)는 공개적으로 비트코인 외 모든 증권을 가상화폐로 본다고 표현한 바 있다. <\/p>

SEC는 바이낸스와 코인베이스를 상대로 한 기소장에서 BNB, BUD, 솔라나(SOL), 카르다노(ADA), 폴리곤(MATIC), 파일코인(FIL), 코스모스(ATOM), 더샌드박스(SAND), 디센틀럴랜드(MANA), 엑시인피니티 샤드(AXS), 코티 네트워크(COTI) 등을 비롯한 수십 개의 코인을 모두 증권이라 주장했다. <\/p>

SEC는 XRP도 미등록 증권이라 주장하며 2020년 12월부터 리플사와 법적 분쟁을 벌였다. 최근 법원 판결이 나오며 리플에 유리한 방향으로 가는 듯 보이기도 했다. <\/p>

SEC로 저해되는 혁신, 의회에서는 도움의 기미 안 보여<\/strong><\/h2><\/span>

비판가들은 미국 암호화폐 산업에 대한 SEC의 공격적 태도가 산업의 혁신을 저해하고 있다고 주장하며 유망한 산업이 아랍에미리트나 영국 등 친화적 관할권으로 옮기는 결과로 이어지고 있다고 설명했다. <\/p>

미국 의회 역시 큰 도움이 되지 않고 있다. <\/p>

미 달러 페깅 스테이블코인을 발행하고 싶은 기관을 위한 공화당 지지 법안이 최근 미국 하원 금융서비스위원회(House Committee on Financial Services)을 통과해 곧 투표가 임박했다. 하지만 양당간의 합의가 부족해 의회를 통과해 대통령의 서명을 받을 가능성이 희박해보인다. <\/p>

공화당 의원 신시사 루미스(Cynthia Lummis)와 민주당 커스틴 길리브랜드(Kirsten Gillibrand)의 노력으로 작업 중인 광범위한 가상화폐 법안은 아직 갈 길이 멀어 보인다. <\/p>

2024, 암호화폐 규제에 중요한 해 될 수 있어<\/strong><\/h2><\/span>

2024년은 미국 암호화폐 규제에 있어 중요한 한 해가 될 수 있다. <\/p>

의회가 드디어 가상화폐 법안을 통과하는 해가 될 가능성도 존재한다. <\/p>

코인베이스와 바이낸스 등 주요 가상화폐 거래소와 SEC 간의 소송 결과가 나올지도 모른다. <\/p>

SEC는 또한 블랙록과 뱅가드 등 월가의 대가가 제출한 비트코인 현물 ETF를 승인할지 결정할 것으로 기대된다. <\/p>

지금까지 위원회는 모든 비트코인 현물 ETF 신청을 거절했지만, 블랙록 등 대형 금융 기관을 일반적으로 거절하지 않았을 뿐더러, ETF 신청서에 시장 감시 메커니즘 등을 제안했기에 기대가 크다.
