미국 은행 산업의 발전을 지지하는 기관인 은행정책연구소(Bank Policy Institute, BPI)가 최근 상원의원 엘리자베스 워렌(Elizabeth Warren)의 가상화폐 규제 강화 노력을 공개적으로 지지했다. <\/p>

워렌과 다른 세 명의 상원 의원은 최근 디지털 자산 자금세탁 방지법을 재발의하였다. 법안은 암호화폐 산업이 직면한 자금 세탁 및 테러리즘 자금 조달 문제 등에 대응하기 위해 규제를 강화하는 것을 목적으로 한다. <\/p>

블룸버그의 금요일 보도 기사<\/u><\/a>에 따르면, 그동안 워렌의 비판을 받았던 BPI가 이제 양당 발의 법안을 지지하고 나섰다. <\/p>

BPI는 성명을 통해 “기존의 자금세탁 방지법과 은행 보안법(BSA)도 디지털 자산을 고려해야 한다. 우리는 이 과정에 참여해 국가 금융 시스템을 모든 형태의 불법 행위로부터 보호할 것이다.”라고 밝혔다. <\/p>

총 7쪽에 달하는 법안이 통과된다면 디지털 자산 지갑 제공사와 채굴 기업과 기타 블록체인 검증자가 고객 신원 기록을 보관해야 한다. <\/p>

게다가 금융 기관에서 블록체인 데이터를 혼란스럽게 만들기 위해 설계된 토네이도 캐시(Tornado Cash)와 같은 디지털 자산 믹서의 사용이 금지된다. <\/p>

워렌과 웨스트 버지니아주 상원의원인 민주당 조 맨친(Joe Manchin), 공화당 소속의 캔자스 주 상원의원 로저 마샬(Roger Marshall)과 사우스캐롤라이나 주 상원의원 린지 그레이엄(Lindsey Graham) 등은 금요일에 법안을 재발의했다. <\/p>

고객 신원 추적 외에도 법안은 미 재무부와 증권거래위원호(SEC), 상품선물거래위원회(CFTC) 등이 AML 및 테러 자금 조달 규정 준수를 위한 새로운 조사 절차를 마련할 것을 요구한다. <\/p>

매사추세츠주 은행가 협회(Massachusetts Bankers Association), AARP, 전국 소비자 법률 센터(National Consumer Law Center), 전국 소비자 연맹(National Consumers League)도 법안을 지지한다. <\/p>

신규 법안 공격하는 크립토 베테랑<\/strong><\/h2><\/span>

한편 암호화폐 커뮤니티 모두가 워렌의 발의안을 지지하는 것은 아니다. <\/p>

제미니(Gemini) 암호화폐 거래소 공동 창업자 타일러 윙클보스(Tyler Winklevoss)는 7월 28일 트위터에 법안을 비판하는 글을 올리며 워렌의 법안에 반대하는 이들이 “옳은 일을 하고 있다“라고 언급했다. <\/p>

워렌은 2022년 12월에 해당 법안을 미국 상원에 발의하며 기존의 자금세탁방지법이 가상화폐 산업을 충분히 포함시키지 못한다고 주장했다. <\/p>

2월 14일에 진행된 “가상화폐 붕괴: FTX 버블이 붕괴된 이유 및 소비자 피해” 제목의 상원 은행 위원회 청문회에서 워렌은 가상화폐가 전통 금융 기관과 동일하게 규제 받아야 한다고 지적했다. <\/p>

그녀는 코드로 운영되는 탈중앙화 주체에 대한 예외 적용에 반대하며 이러한 틈새가 불법 활동을 수행하는 이들에게 자금 세탁 수단을 제공할 수 있다고 주장했다. <\/p>

워렌 외에도 미국 SEC 의장 개리 겐슬러 역시 가상화폐 시장에 적대적인 비평가 중 하나이다. <\/p>

겐슬러는 최근 인터뷰에서 암호화폐 시장에 만연한 사기에 대한 우려를 표하며 범법자가 “지나치게 많다”라고 주장했다. <\/p>

그는 가상화폐 투자자에게 비록 같은 법의 적용을 받는다 하더라도 증권법과 동일한 보호를 받을 수 있으리라 짐작하지 말 것을 권고하며 다음과 같이 말했다:<\/p>
