미국 증권거래위원회(SEC)와 리플이 윌리엄 힌먼(William Hinman) 전 이사의 연설과 관련된 내부 문서의 봉인 기간을 1주일 연장해줄 것을 법원에 요청했다.<\/p>

SEC와 리플 모두, 지난주 금요일에, 힌먼의 문서를 포함한 여러 관련 증거 자료들에 대한 봉인 기간 연장을 청구하였다.<\/p>

변호사이자 전직 연방 검사인 제임스 필란(James Filan)에 의하면, 같은 날 미국 뉴욕 남부 지방법원의 애널리사 토레스(Analisa Torres) 판사는 신청을 받아들여 6월 13일을 새로운 기한으로 결정하였다.<\/p>

SEC와 리플은 “2023년 6월 13일까지 1주일의 기한 연장을 청구하는 공동 서한을 제출하였으며, 힌먼의 자료가 포함된 약식 판결에 대한 교차 동의안 및 관련 증거 자료의 [민감한 사항이 편집된] 버전을 공개할 것”을 요청했다<\/p>

힌먼 문서에서 힌먼 전직 위원장의 2018년 6월 연설문이 주요 자료에 해당한다. 이 시기에 그는 이더리움 블록체인의 기본 토큰인 ETH가 증권이 아니라고 선언한 바 있다.<\/p>

지난해 12월 SEC는 리플 소송 과정에서, 힌먼의 연설 이후의 이메일, 문자 메시지, 전문가 보고서 등의 내부 커뮤니케이션 자료를 봉인해 달라는 신청서를 제출한 바 있다.<\/p>

SEC는 자신들의 업무의 중요성이 대중의 해당 문서에 대한 알권리에 우선한다고 주장했다. SEC는 해당 문서들이 법원의 약식 판결 과정과 관련성이 많지 않다는 등의 이유를 들었다. <\/p>

그러나, 토레스 판사는 내부 심의 기록을 비공개 해달라는 SEC의 요청을 이번 주 초에 기각했다.<\/p>

해당 판사는 관련 문서들이 일반 대중의 알권리가 보장되어야 하는 “사법 문서”라고 주장하였다. 또한 힌먼의 연설문은 “[법원의] 판결에 충분히 영향을 미칠 수 있는 가능성이 있는 문서이다”라고 부연하였다.<\/p>

암호화폐 관련 주요 판례로 남게될 리플-SEC 사건<\/h2><\/span>

리플과 SEC의 사건은 리플과 XRP를 넘어서는 의미를 갖고 있다. 이 사건은 암호화폐들에 대한 규제와 분류 방식과 관련하여 앞으로 중요한 판례가 될 수 있다.<\/p>

반면에, 리플이 증권이 아니라는 판결이 내려진다면, 리플과 유사한 특성을 갖는 다른 암호화폐들도 증권 관련 규제에서 벗어날 수 있게 될 것이다.<\/p>

리플-SEC의 소송 결과는 암호화폐 산업 전반에 중요한 의미를 갖고 있으며, 암호화폐 기업의 운영과 규제 방식에 지속적으로 큰 영향을 줄 수 있다.<\/p>
