Hong Ko pourrait instaurer un régime spécial pour les stablecoins d’ici fin 2024<\/h2><\/span>

La Hong Kong Monetary Authority (HKMA) <\/strong>– en français l’Autorité monétaire de Hong Kong – a pour projet d’établir un cadre légal autour des stablecoins d’ici la fin 2024<\/strong>. Le sous-secrétaire aux services financiers et au Trésor de la ville, Joseph Chan Ho-lim<\/strong>, a récemment déclaré que le projet de réglementation était en plein processus de commentaire de la part du public<\/strong>, et surtout des acteurs de l’industrie<\/strong>. <\/p>

Le projet de réglementation hongkongaise des stablecoins ne date pas d’hier. En effet, la région autonome chinoise avait déjà publié un document de travail <\/strong>sur le sujet en janvier 2022<\/strong>. Celui-ci fut suivi d’une conclusion de ce document publiée un an plus tard <\/strong>affirmant la nécessité d’un tel cadre réglementaire. <\/p>

La réglementation devrait essentiellement concerner les stablecoins utilisés en tant que moyen de paiement<\/strong> et les stablecoins indexés sur les monnaies fiduciaires<\/strong>. Selon les législateurs hongkongais, ceux-là sont les plus susceptibles de présenter des risques<\/strong> pour la stabilité financière.<\/p>

Le projet de réglementation insiste sur le fait que les stablecoins doivent être garantis par des actifs de haute qualité<\/strong> et à forte liquidité<\/strong>. Par conséquent, le document actuellement débattu rejette totalement les stablecoins algorithmiques comme l’UST. Les législateurs insistent également sur le fait que les détenteurs de stablecoins devraient être en mesure d’échanger ces derniers contre des monnaies fiduciaires dans un délai raisonnable.<\/strong><\/p>

On notera enfin que Hong Kong est pionnière dans le domaine<\/strong> de la réglementation des stablecoins. La ville a participé à l’élaboration de normes et de standards légaux<\/strong> concernant les stablecoins pour le Conseil de Stabilité Financière (CSF)<\/strong>, organisation internationale qui coordonne et surveille les politiques et les réglementations financières à l’échelle mondiale. <\/p>

Les USA comptent également introduire un cadre réglementaire vis-à-vis des stablecoins <\/h2><\/span>

Les Etats-Unis sont entrés dans une période très active<\/strong> concernant la réglementation des crypto-monnaies<\/a>. La Securities and Exchange Commission (SEC)<\/strong> et la Commodity Futures Trading Commission (CFTC)<\/strong> ont d’ailleurs récemment porté des charges et des accusations contre des acteurs importants de l’industrie comme BinanceUS<\/strong><\/a> ou Coinbase<\/strong>. <\/p>

Mais tout le monde, et en particulier les sociétés crypto<\/strong>, désirent l’implémentation d’un cadre légal clair pour l’industrie, cela incluant bien sûr les stablecoins.  <\/p>

Concrètement, la United States House Financial Services Committee<\/strong><\/i> – en français la Commission des services financiers de la Chambre des représentants des États-Unis – a introduit, depuis début 2023, trois projets de lois <\/strong>au sujet des stablecoins. On citera le dernier d’entre eux qui veut donner des pouvoirs importants à la Réserve fédérale <\/strong>(banque centrale des États-Unis),<\/strong>  tout en laissant une certaine capacité d’intervention aux régulateurs de l’État<\/strong>. <\/p>

Ces projets de lois continueront d’être discuté entre le Sénat et la Chambre des représentants<\/strong>. Au moment du vote, ils déboucheront sur le premier cadre législatif donnant une vision d’ensemble de la manière dont les stablecoins doivent être déployés sur le marché US<\/strong>. <\/p>
