根据《南华早报》的报道<\/a>，在由中国国务院总理李强主持召开的一次会议上讨论了草案修正案，该修正案将很快由全国立法机构审议。<\/p>

尽管尚未公布拟议修正案的全文，但法学专家指出，其主要目标是打击涉及虚拟资产的洗钱活动。<\/p>

中国数字新闻媒体《界面》援引了上海复旦大学中国反洗钱研究中心执行主任严立新的话指出，有关应对涉及虚拟资产的洗钱活动的紧迫性。\n<\/p>

中国采取主动措施打击加密货币<\/h2>

<\/span><\/p>

\n中国在打击洗钱方面的最新举措反映了政府保持与Web3空间发展同步的决心，包括非同质化代币和其他虚拟资产。<\/p>

这一努力与中国对加密货币操作（如挖矿和交易）的坚定禁令保持一致。<\/p>

预计明年将通过的AML法律的即将出台的修正案旨在解决新兴形式的洗钱风险。<\/p>

参与法律修订讨论的北京大学法学院教授王欣强调了需要适应不断发展的实践。<\/p>

最高人民检察院的高级检察官张晓晋表达了加强打击洗钱和非法外汇交易犯罪的承诺，特别是涉及数字货币用于资产转移至国外的案件。<\/p>

近年来，中国当局加大了对与加密货币相关的洗钱案件的审查力度。<\/p>

2022年，内蒙古自治区警方逮捕了63人，因涉嫌使用加密货币洗钱120亿元人民币（约合17亿美元）<\/a>。\n<\/p>

中国的AML在17年间保持不变<\/h2>

<\/span><\/p>

\n中国的AML立法自17年前颁布以来基本未变，未能考虑到比特币（BTC）<\/a>等加密货币的出现。<\/p>

根据香港金杜律师事务所合伙人费安德鲁的说法，修改中国的AML法律以应对虚拟资产相关的风险被认为是必要的，考虑到国际标准和最佳实践的显著发展。<\/p>

金融行动特别工作组（FATF）是一个打击洗钱和恐怖主义融资的政府间机构，已经提出了详细的建议，以应对拟议中的AML法修正案中的虚拟资产。<\/p>

尽管FATF将中国大陆评为对虚拟资产相关的AML建议“基本符合”，但该国对加密货币活动的禁止使其免于几项标准。<\/p>

费安德鲁表示，中国应将相关的FATF建议纳入修订后的AML法律中。<\/p>

他建议授予当局额外的权力和工具，以针对虚拟资产和新技术带来的独特挑战。<\/p>
