تنبّأ الباحثون في منصة التداول الكوريّة<\/u><\/a> الجنوبيّة<\/u> بيتهامب (Bithumb) أن يشهد العام القادم عودة الثّقة في قطاع الكريبتو، مُستندين في رؤيتهم هذه إلى ثلاثة أسبابٍ رئيسيّة، علماً أنّ منصة بيتهامب (Bithumb) هي إحدى أهمِّ منصَّتين للتداول في كوريا الجنوبية، وتقومُ بإدارة قسمٍ مختصٍ بالأبحاث والتحليلات -Bithumb Economic Research Institute- يتولّى مهمّة دراسة توجّهات السوق.<\/p>

ووفقاً لـ Business Post<\/u><\/a>، فإنّ توقّعات مركز الأبحاث فيما يخصُّ العملات الرقميّة لعام 2023 تضمُّ عدداً من التكهّنات عن المستقبل القريب لقطاع الكريبتو في خِضَمِّ انشغال صنّاع القرار في تحضيراتهم لقوانين تنظيميّة بخصوص هذا القطاع، وإليكم أسباب تفاؤل الباحثين بالعام المقبل.<\/p>

الفصل في قضيَة Ripple<\/h2><\/span>

ينظر الباحثون إلى القضيّة القانونيّة<\/u><\/a> بين Ripple ولجنة الأوراق المالية والبورصات (SEC) “كأكثر الأحداث أهميّةً في عام 2023” في قطاع العملات الرقميّة، ويرجع ذلك -وفق ما أوضحوه- إلى أن “الولايات المتحدة الأمريكيّة هي مركز قطاع الكريبتو”، وأن نتيجة هذه القضيّة ستكون لحظةً مفصليّةً في تاريخ هذا القطاع<\/p>

ويتوقّعُ الباحثون أنّ عدداً كبيراً من العملات الرقميّة ذات القيمة السوقيّة العالية سيتم إدراجها ضمن اختصاص هذه الهيئة في حال فوز لجنة الأوراق المالية والبورصات (SEC) بالدعوى القضائية، ومن المرجّح أن تكون القوانين التنظيمية الصّادرة عنها أقلَّ تسامحاً من القوانين التي تُصدرها لجنة تداول السلع الآجلة (CFTC)، والتي تتمتع “بمستوى صرامة أقلَّ في قوانينها التنظيميّة”.<\/p>

أمّا في حال فوز ممثِّلي Ripple، فلن يتمّ تطبيق القوانين الصادرة عن لجنة الأوراق المالية والبورصات (SEC) على معظم العملات الرقمية؛ وفي حال انتهت القضيّة بتسويةٍ قضائية، فقد يعني هذا عدم حدوث أثر يُذكَر.<\/p>

التحديات المتعلقة بالقوانين والتشريعات في الولايات المتحدة<\/h2><\/span>

رأى الباحثون أنّه لن يكون من “الواقعيّة” توَقُّعُ قيام الكونغرس بتمرير أيٍّ من مشاريع القوانين الحالية المتعلقة بالكريبتو، والتي تم اقتراحها على مجلس النواب قبل نهاية الدورة الحالية (والتي ستنتهي في 3 كانون الثاني\/يناير)، حيث سيتم إلغاء جميع مشاريع القوانين الحالية بعد نهاية الدورة، ممّا يعني أنَّ المُشَرّعين سيحتاجون إلى البدء من جديد بمشروع قانونٍ لتنظيم الكريبتو في عام 2023؛ وبالرغم من أنّ هذه البداية لن تعيق صنّاع القرار، إلا أنّ التحديات ستستمر مع سيطرة الجمهوريين على مجلس النواب، بينما سيُشكِّل الديمقراطيون أغلبيةً ضئيلةً في مجلس الشيوخ تبعاً لنتائج الانتخابات النصفيّة في الشهر الماضي.<\/p>

بناءً على ما سبق، توقّع بعضُ المراقبين الكثير من حالات عدم الاتفاق بين مجلسي الكونغرِس، في حين توقّع آخرون مضيّ الأمور بسلاسةٍ بالنسبة للسلطة التنفيذية؛ إلا أنّه بغضّ النظر عمّا سيحدث مع اجتماع المُشَرِّعين مرةً أخرى، لم يتوصّل أيٌّ من المجلسين إلى اتفاقٍ فيما يخصّ السياسة المتعلقة بالكريبتو في السابق، لكن من المرجّح -على الرغم من التحديات الحالية- أن تظلَّ هنالك رغبةٌ بوضع قانونٍ تنظيميٍّ يمنع تكرار ما حدث مع FTX<\/u><\/a>.<\/p>

ويرى الباحثون أنّ مشروع قانون الأصول الرقميّة الأمريكي “يمكن أن يُقِرَّه الكونغرس في حلول نهاية عام 2023”.<\/p>

استصدار المزيد من القوانين التنظيمّية في كوريا الجنوبية<\/h2><\/span>

فيما كان من المرجّح أن يُشكّلَ انهيار FTX نقطة تحوّلٍ في قطاع العملات الرقميّة الأمريكي، لم يَكنْ له تأثيرٌ يُذكر<\/u><\/a> على معظم شركات الكريبتو في كوريا الجنوبية؛ وقد مرّت كوريا الجنوبيّة بنقطة تحوّل مُماثلة قبل أشهرٍ من انهيار FTX، وسُمِّيَت بـ حادثة تيرا\/لونا (Terra\\Luna Incident)<\/u><\/a>؛ ومن الجدير بالذكر أنّ محاولات القضاء تعقّبَ Do Kwon<\/u><\/a> واعتقال المدراء التنفيذيين في Terraform Labs باءت بالفشل، فيما طالب المئاتُ من مستثمري عملة Terra الغاضبين بتحقيق العدالة؛ ما أثار رغبة كوريا الجنوبيّة بتفادي تكرار هبوطِ السوقِ الكارثيّ الذي شهدته في أيّار\/مايو الماضي.<\/p>

ووِفقاَ لمركز الأبحاث Bithumb Economic Research Institute، فإنّ القوانين التنظيمية قادمةٌ -دون شك- بسبب حادثة تيرا لونا، حيث يوجد حالياّ أربعة عشر مشروعَ قانونٍ خاصٍّ مُقدَّمٍ للجمعية الوطنية، منها -على الأقل- مشروعان واعدان من المرجّح أن يتمّ إقرارُهما؛ وقال الباحثون: “بغضّ النظر عن القانون الذي سيتم إقراره من بين مشروعي القانونين، فإنّ إجراءات حماية المستثمرين ستكون أكثر صرامةً من أيِّ وقتٍ مضى”، وقد صرّح Oh Yu-ri مدير فريق الأبحاث السياسيّة:<\/p>
